近日,网购“刷单”行为被各大媒体相继曝光,引起社会各界广泛热议。所谓网络“刷单”是指通过“刷单军团”当托儿,虚构出网店的高销量和“好评”,以吸引更多的顾客。网购“刷单”行为的大量存在不仅扰乱了网购市场秩序、侵犯了消费者的合法权益,更可能滋生新型的“传销”组织。对此,工商部门应采取行之有效的措施加强对网络“刷单”行为的监管。
一、网购“刷单”行为的危害性
一是扰乱网购市场秩序。由于在网购交易平台上,两家网店销售同样的商品且价格差别不大的情况下,消费者往往会更倾向选择销量高、评价多的商家购买,因此,部分商家雇佣水军刷单、刷信誉,必然使其他恪守公平、诚信、自愿、守信等市场基本准则的商家受到市场无情的挤压;加之网店销量靠前才能搜索靠前,使得网店经营者不“刷单”就没有生存空间,久而久之,还会形成“劣币驱除良币”的互联网营销生态,严重扰乱了网购市场公平竞争秩序。
二是侵犯消费者合法权益。一方面,“刷单”需要支付一定金额的佣金,且商品价格越高、佣金越高,从一定程度上拉高了商家的成本,而“羊毛出在羊身上”,这一部分成本自然转嫁到消费者身上,让消费者在毫不知情的情况下为其“刷单”行为买单。另一方面,部分披着国外代购虚假外衣或选择国内优秀品牌进行高仿的造假者,通过“刷单”制造让人信服的好评店铺,不仅妨碍了消费者的正确选择和判断,更可能使假货、高仿货充斥市场。
三是滋生新型“传销”组织。据报道,“刷单”军团一些所谓的“上线”,会在各个论坛、贴吧留下自己的QQ号码,前缀多是“网络兼职”并且会附有“月薪过万不是梦”的蛊惑性语言。一旦有动心者,接下来会有YY公会等组织接手对其进行洗脑、专业培训并考核。而在提成方面,每为军团拉来一个客户,推荐者都可以得到50%的入会费提成,“刷单”所得的佣金,会被管理员抽走30%左右。“刷单”军团的提成方式及组织方法和传销组织没什么两样,在淘宝做大做强的背景下,俨然形成一条“附体吸血”的新型产业链。
二、加强对网购“刷单”行为监管的对策
一是强化网购教育引导。工商部门、消委会应利用各类普法宣传活动契机,通过发放宣传资料、发布消费警示等形式,向广大网购消费者曝光“刷单”这一网购消费陷阱,引导其在选择网购商家时不要只一味关注网店的销售量、好评等信息,应同时注重消费者给予的中评、差评等评价;提醒其在选择海外代购商家或购买名牌商品时应“货比三家”,对部分价格过于偏低但销售、好评多的商家多留意是否“刷单”所为并谨慎购买。
二是推进商家诚信自律。工商部门应依托经济户口,对辖区网店经营户进行排查摸底、登记造册,并定期不定期通过召开培训会、开展上门指导、进行个别约谈等形式,向商家宣传新《消法》、《网络商品交易管理办法》等相关法律法规,提升其法律认识和违法成本意识,使其牢固树立诚信、自律意识,主动抵制“刷单”行为。
三是加大执法监督力度。一方面,工商部门应主动加强与淘宝网的联系沟通,要求其利用自有专业机器和专门团队,加强对涉嫌刷信誉和好评的店铺进行清查,并将可能存在“刷单”行为的商家及时上报工商部门调查;同时,鼓励网店商家向工商部门投诉举报“刷单”商家,以便工商部门借《网络交易管理办法》实施契机,让违规者付出法律和金钱上的惨重代价,形成“不敢刷也不能刷”的互联网生态。另一方面,工商部门应加大对“刷单”军团涉嫌传销行为进行深入调查、取证、打击,对涉嫌犯罪的及时提请公安部门介入,从源头上打击网购“刷单”产业链主体。
